This Privacy Statement applies to Marlin Leasing Corporation d/b/a PEAC Solution’s operation of www.leaseservices.com and www.peacsolutions.com, and other pages and websites owned and operated by Marlin Leasing Corporation (“we” or “us” or “our”). The Privacy Statement applies to information collected online through our website and sites (each a “Site”). This Privacy Statement describes how we collect, use, process, and share the information you provide, or which is automatically generated and collected when you interact with our Site. It also describes the choices available to you regarding the use of, your access to, and how to update and correct your information.

Our Privacy Statement is set forth below:

1. COLLECTION AND USE OF INFORMATION

You may be asked to provide certain information about you and/or your company if you elect to apply for financing through the Site or if you attempt to use certain Site functions. You may also be asked to provide certain information via e-mail, text and other electronic messages. The decision to provide this information is entirely yours.

We collect the following identifying information from you when you elect to apply for financing:

  • Information such as business name, contact email address, address, phone number;
  • Tax ID;
  • Financial Information such as bank name, routing number, account number;
  • Beneficial ownership information.

We collect information on the beneficial owners of your company for purposes of verifying their identity only. The United States Government implemented the beneficial ownership rule to help deter and investigate financial crimes. We will maintain beneficial ownership information in our records pursuant to this Privacy Statement.

Additionally, in the event you provide a personal guarantee we will collect the following personal information:

  • Date of Birth;
  • Social Security Number.

We limit the use of sensitive personal information to what is necessary to provide our services, comply with legal obligations, and protect against fraud.

In order to provide services requested by you, we may use third party service providers such as Plaid Inc. (“Plaid”) to gather your data from financial institutions. When you apply for our services, you expressly authorize us and our third-party providers, including Plaid, to access and transmit your personal and financial information from your financial institution on your behalf. Your personal information provided by any such third parties will be transferred, stored, and processed in accordance with the applicable third-party privacy policy, a copy of which we will provide to you if requested.

User Data Supplementation

We may receive information about you from other sources, including publicly available databases or third parties from whom we have purchased data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you. If you provide us with personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us.

Examples of the types of personal information that may be obtained from public sources or purchased from third parties and combined with information we already have about you may include:

  • Address information about you from third-party sources, such as the U.S. Postal Service, to verify your address as part of our “know your customer” (KYC) program to prevent fraud.
  • Purchased marketing data about our customers from third parties that is combined with information we already have about you, to create more tailored advertising and products.

We will use the information you furnish to evaluate your application, provide you with updates regarding the application’s status and, if appropriate, initiate the funding process. We will also use the information you provide to service and administer any accounts you may have with us and to offer you other products and services available through us or other entities. In addition, we may use the information provided by the Site users for analytical, statistical, marketing or other purposes, including but not limited analytics, statistical analysis, and, where permitted by applicable law, the development and improvement of automated tools and models using aggregated or de-identified data.

We limit employee access to the information you provide to those employees who have a business reason to know such information. We may also share your information with our affiliated companies consisting of any entity that controls, is controlled by, or under common control with Marlin Leasing Corporation.

2. DISCLOSURE OF PERSONAL INFORMATION

We will share your personal information with third parties only in the ways that are described in this Privacy Statement.

We may share the information you choose to provide with our suppliers, financing sources, equipment vendor contacts and other business customers (collectively, the “Third Parties”) in order to:

  • Evaluate and process your application for funding;
  • Service your account;
  • Offer products and services that may be of interest to you; and/or
  • Conduct and administer our business.

In addition, we may share the information you choose to provide:

  • As required by law, such as to comply with an order, subpoena, audit, bankruptcy proceeding, or similar legal process in certain situations;
  • If we are required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements;
  • We may disclose information when we reasonably believe it is necessary to: (i) protect our rights; (ii) ensure safety; (iii) investigate fraud; or (iv) respond to government requests;
  • If we are involved in a merger, acquisition, or sale of all or any portion of our assets, including but not limited to an asset transfer as part of a bankruptcy proceeding, in which case you will be notified via email and/or a prominent notice on our website of any resulting change in our ownership, uses of your personal information, and choices you may have regarding your personal information; and/or
  • With any other third party with your prior consent.
  • In connection with any action we decide to take to enforce our rights against you, including but not limited to rights we have under any agreements with you.

The third parties with whom we conduct business are aware of the importance of your privacy and are expected to comply with all applicable privacy laws. However, we do not control the actions and privacy practices of any third parties and therefore recommend that you review their privacy policies. Upon request, we will provide you with the names of such third parties and a link to each third party’s privacy policy.

3. YOUR PRIVACY CHOICES AND RIGHTS

Your Privacy Choices. The privacy choices you may have about your personal information are determined by applicable law and are described below.

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding us and our services, and you will not be able to opt out of those communications (e.g., communications regarding our services or updates to our Terms or this Privacy Policy).
  • Push Notifications. We may send you push notifications through our mobile application. You may opt out of receiving these push notifications by changing the settings on your mobile device.
  • Phone calls and Text Messages. If you receive an unwanted phone call or text message from us, you may opt out of receiving future phone calls or text messages from us by following the instructions which may be available on the call, in the message or by otherwise contacting us as set forth in “Contact Us” below.
  • “Do Not Track. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals; however, we do honor the Global Privacy Consent (“GPC”) where required by applicable law.

Cookies and Personalized Advertising. You can control the use of certain cookies and Technologies on our services in the following ways:

  • Website Cookie Controls. When you first visit our website, you will be presented with a banner that informs you about the categories of cookies and other tracking technologies (“Technologies”) used on that Site and your options for controlling those technologies based on the jurisdiction applicable to your use of the website.   Depending on the laws applicable in your jurisdiction, you will have a choice about whether to accept or opt-out of certain cookies and technologies, the use of which may constitute a “sale” or “share” of personal information under applicable law and may be used for targeted advertising. Please note that cookies are browser and device-specific.  Your request to opt-out or reject the use of these Technologies will be linked to your browser identifier only. However, if you adjust your preferences, our services may not work properly. Please note that cookie-based opt-outs are not effective on mobile applications. In addition, the online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. You can access these websites and learn more about targeted advertising, consumer choice, and privacy by visiting the Network Advertising Initiative, the Digital Advertising Alliance, the European Digital Advertising Alliance, and the Digital Advertising Alliance of Canada. Please note you must separately opt out in each browser and on each device.
  • Global Privacy Control. You may exercise your opt-out right by broadcasting an opt-out preference signal, called Global Privacy Control (GPC), on the browsers and/or browser extensions that support such a signal. If you use a different computer or Internet browser to access our Sites, you will need to renew your opt-out request.

Your Privacy Rights. In accordance with applicable law, you may have the right to:

  • Access to and Portability of Your Personal Information, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information; and (iii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine readable format (also known as the “right of data portability”);
  • Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;
  • Request Deletion of your personal information;
  • Request Restriction of or Object to ourprocessing of your personal information where the processing of your personal information: (i) is based on our legitimate interest for direct marketing purposes; (ii) involves processing or sharing of your sensitive personal information for certain non-essential purposes, or in contexts that require your consent; and (iii) is based solely on automated decision making or for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you;
  • Opt-out of Sale, Sharing for Cross-Contextual Advertising, or Targeted Advertising involving your personal information.  Although we do not “sell” your personal information as the term “sale” or “sell” is typically understood or defined under applicable law, we may share your information with analytics providers and advertising networks in order to understand how visitors use our websites and serve you ads on and off our websites.  You may opt-out of this “sharing” and “targeting advertising” by adjusting your privacy choices as described above.
  • Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.

4. INACCURATE INFORMATION

We may retain information such as your company name, principal officer names, company address, personal and corporate identification information such as government issued tax identification numbers, driver’s license information, corporate tax returns (if provided) or other similar information used to confirm your company or an individual’s identity. Upon request, we will provide you with information about whether we hold any of your personal information. If you believe that our records contain inaccurate or incomplete information about you or your company, you may correct, update, amend, delete/remove information by contacting us as described in the “Contact Us” section of this Privacy Statement. We will review your concerns, respond within a reasonable time frame and correct our records if necessary.

5. SECURITY OF INFORMATION

We protect your information by maintaining security procedures to prevent unauthorized access to your information. We use SSL encryption (Secured Socket Layer) Technology and other forms of technology to help ensure the protection of your information. Unfortunately, no system is 100% secure, and we cannot ensure or guarantee the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information. 6. “COOKIES” AND OTHER TRACKING TECHNOLOGIES

Technologies such as cookies, beacons, tags, script or similar technologies are used by us and our partners, affiliates, analytics or service providers. These technologies are used in analyzing trends, administering the website, tracking users’ movements around the Site, and gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.

Cookies are small pieces of data that are stored on your device’s browser by a website you visit. Cookies keep track of your movements within the Site, remember your user preferences, and help to make a website more useful to you. We utilize cookies for user authentication, to prevent fraud, to help our Site deliver the appropriate services to its users, and for analytics and marketing. This information may include users’ movement and interaction with the Site, including mouse movements, non-sensitive text entered, pages visited and links clicked, as well as internet protocol (IP) addresses, browser type, internet service provider (ISP), cookie information, referring/exit pages, operating system, date/time stamp, and/or clickstream data (collectively, “Usage Data”). Our purpose in collecting Usage Data is to better understand how our users interact with the Site. Usage Data helps us to keep our website fresh and functional and enables us to tailor content to a user’s interests.

We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, or Site functionality.

We use Local Shared Objects, Local Storage, such as HTML5, to store content information and preferences. Various browsers may offer their own management tools for removing HTML5.

We partner with a third party to display advertising on our website and to manage our advertising on other sites. Our third-party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. 7. CHILDREN

Our Site is not intended for children under 18 years of age. No one under 18 may provide any information on the Site. We do not knowingly solicit or collect personal information from, or market our services or products to, children under 18. If you are under 18, do not use or provide any information on this Site or through any of its features, register on the Site, or provide any information about yourself to us, including your name, address, telephone number or email address. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. 8. AUTHORIZATION AND CONSENT TO USE INFORMATION

By providing information to us through this Site or otherwise, you authorize and consent to our use of such information in accordance with this Privacy Statement and in other similar manners.

Under the California Consumer Privacy Act (“CCPA”), if you are a California resident, you may, subject to certain limitations and exceptions, have additional following rights with respect to information we have collected about you that constitutes personal information under the CCPA, including but not limited to the following: (i) to request access to more details about the categories and specific pieces of personal information we may have collected about you in the last 12 months (including personal information disclosed for business purposes); (ii) to request deletion of your personal information; and (iii) to not be discriminated against for exercising these rights.

To exercise your data protection rights, where applicable, you can submit a request by contacting us as described in the “Contacting Lease Services” section of this Privacy Statement. You may be required to provide additional information necessary to confirm your identity before we can respond to your request. We will consider all such requests and provide our response within a reasonable period of time (and within any time period required by applicable law). However, certain information may be exempt from these requests for legal or other purposes.

9. TESTIMONIAL

We display personal testimonials of satisfied customers on our website in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us as described in the “Contacting Lease Services” section of this Privacy Statement.

10. THIRD-PARTY LINK

This Privacy Statement only applies to the use and disclosure of information collected through our Site. Our website includes links to other websites whose privacy practices may differ from those of ours. If you submit personal information to any of those websites, your information is governed by their privacy statements. We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Statement, including complying with legal, regulatory, tax, accounting, and reporting obligations, or as needed to provide you with services, or to comply with our Records Retention Policy. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We may update this Privacy Statement to reflect changes to our information practices. If we make any material changes, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Statement if you continue to use our Site or services after the new Privacy Statement takes effect. Additional Privacy Rights for Residents of Certain States

Subject to Applicable Law, if you are a resident of certain states you may have the rights described in the section titled  Your Privacy Rights and Choices,  in the Privacy Policy, which you may include the following rights: The right to know and access the person we have collected about you; the right to delete personal information we have collected; the right to opt-out or restrict the processing of personal information for specified purposes, such as targeted or cross contextual advertising, and, the right to correct inaccurate personal information.

In accordance with Applicable Law, you may also have the following rights:

Non-Discrimination. We will not discriminate against you, in terms of price or services that we offer, if you exercise any of the rights listed above.

Authorized Agent. Depending on where you live, you may have the right to use an authorized agent on their behalf to exercise the privacy right discussed above. If you are an authorized agent acting on behalf of a user to communicate with us or to exercise a privacy right discussed above, you must be able to demonstrate that you have the requisite authorization to act on behalf of the user, and have sufficient access to that user’s laptop, desktop, or mobile device to exercise that user’s right digitally. If you are an authorized agent trying to exercise rights on behalf of one of our users, then you can make a request on the user’s behalf by contacting us as set forth below in the “Contact Us” section: Such requests must include the following information: (1) a written authorization from the consumer that includes the consumer’s full name, address, telephone number and valid email address used by the consumer to interact with us, that is signed by the consumer and clearly bestows upon the agent the proper authority; and (2) a certificate of good standing with your state of organization.  Alternatively, an acting agent can provide a valid power of attorney signed by the consumer on the agent’s behalf and a valid email address used by the consumer to interact with us.  The email address of the consumer will be used to separately verify the agent’s authority with the consumer.  

Verification. We are required by law to take reasonable steps to verify your identity prior to responding to your request. Please note that your exercise of these rights is subject to certain exemptions to safeguard public interest (e.g., the prevention or detection of crime) and our interests (e.g., the maintenance of legal privilege). If we are unable to process your request via your authenticating yourself on the services, we may verify your request by asking for information sufficient to confirm your identity, based on the information we have on file. Requests to exercise these rights may be granted in whole, in part, or not at all, depending on the scope and nature of the request and as permitted by applicable law. Where required by applicable law, we will notify you if we reject your request and notify you of the reasons we are unable to honor your request.

We will respond to your request within forty-five (45) days or within the time provided for under Applicable Law. However, in certain circumstances, we may require additional time to process your request, as permitted by applicable law. We will advise you within forty-five (45) days after receiving your request if such an extension is necessary and why it is needed. If we cannot fulfill your request, our response to you will also explain the reason why we cannot fulfill your request.

We do not charge a fee to process or respond to your consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.  We will not discriminate against you for exercising your privacy rights.

Appeal.  You may have the right to appeal our decision or response to your request. To exercise your right to appeal, you can submit an appeal request using the same method used to submit your original request, including by contacting us as set forth in “Contact Us” above.

De-Identified Information. If we create or receive de-identified information, we will not attempt to reidentify such information, except to comply with Applicable Law or in accordance with our Privacy Policy.

California Shine the Light. The California “Shine the Light” law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties.

Right for minors to remove posted content. Where required by law, California residents under the age of 18 may request to have their posted content or information removed from the publicly-viewable portions of the services by contacting us directly as set forth in “Contact Us” above.
